Judge Says Biomet Has Met Discovery Obligations and Needn’t Begin Document Search Anew

SOUTH BEND, Ind. — The federal judge presiding over the Biomet M2a Hip proceedings has denied a request by plaintiffs’ counsel that he order Biomet to search its document database again after consultation on predictive coding criteria, saying the company has met its discovery obligations using current methods.
Judge Miller said April 18, in resolving the discovery dispute, the court was not asked to decide whether predictive coding is superior to a keyword search method utilized, in part, by Biomet, but whether Biomet’s document production satisfies its discovery requirements under Federal Rules of Civil Procedure 26(b) and 34(b)(2).
