W. Va. MDL Judge Refuses to Remand Pelvic Mesh Device Case

WHEELING, W. Va. — A West Virginia federal judge has denied a couple’s motion to remand their pelvic mesh repair device case to California state court, ruling that the claims against the non-diverse healthcare defendants are time barred under California’s medical injury compensation reform act.
On April 4, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia found all of plaintiffs’ claims against the healthcare defendants involve alleged professional negligence and therefore are encompassed by the act.
