Texas Plaintiffs Sue Smith & Nephew Over Failed Echelon Femoral Stem

DALLAS — A Texas couple has sued Smith & Nephew in federal court, alleging that the Echelon model femur implanted in the husband’s right hip in 2007 failed because of design and/or manufacturing defects.

Plaintiffs William M. and Barbara Herod filed their five-page complaint against the medical device manufacturer April 1 in the U.S. District Court for the Northern District of Texas.

The Texas couple asserts that there is complete diversity, owing to the defendant’s corporate Tennessee residency, and that the amount in controversy exceeds the District Court’s $75,000 threshold.
