Texas Judge Allows FDA Expert to Testify in Gelatin Capsule Arsenic Case

HOUSTON — A Texas federal judge has refused to exclude the testimony of a plaintiff’s regulatory expert in a gelatin capsule arsenic poisoning case against Watson Pharmaceuticals Inc. and Capsugel Inc., ruling that the testimony is relevant and the expert is sufficiently qualified.
On April 8, Judge Gray H. Miller of the U.S. District Court for the Southern District of Texas ruled that Dr. Linda Motkya may testify as to defendants’ compliance with Food and Drug Administration regulations.
Bailey Silverman was prescribed Taztia XT, a blood pressure medication manufactured by Watson using gelatin capsules made by defendant Capsugel. Silverman alleges …
