Fla. Judge Bars Causation Expert in Trasylol Case; Grants Bayer Summary Judgment

MIAMI — A Florida federal judge has granted Bayer Corp. summary judgment in a Trasylol wrongful death action, finding the plaintiff’s sole causation expert failed to explain the drug’s relative contribution to the decedent’s renal injury or death.
On April 2, Judge Donald M. Middlebrooks of the U.S. District Court for the Southern District of Florida found the evidence indicates that the decedent may have developed renal injury either before ever taking Trasylol, or would have developed it without ever taking the medication.
