COVINGTON, Ky. – A Kentucky federal judge has dismissed with prejudice a suit brought against Eli Lilly & Co. (NYSE: LLY) in connection with its propoxyphene products, ruling the plaintiff failed to properly identify Lilly as the maker of the products he ingested.
In a March 29 order, Judge Danny C. Reeves of the U.S. District Court for the Eastern District of Kentucky explained Illinois law requires plaintiffs to identify the supplier of the product and establish a causal connection between the injury and the product.
