New Jersey Judge Dismisses Casting Firm From Biomet Metal-on-Metal Hip Implant Case

NEWARK, N.J. — A federal judge has dismissed a hip implant plaintiff’s claims against the metal casting company that allegedly made the Biomet M2a-Taper device, saying they are precluded under the Biomaterials Access Assurance Act.

Judge Esther Salas of the U.S. District Court for the District of New Jersey entered an order March 28 dismissing Gregg and Raquel Mattern’s claims against defendants Biomet Fair Lawn LLC and Biomet Fair Lawn LP. Claims against other Biomet entities were not at issue.

The Matterns allege that Gregg’s right hip replacement failed because of defects in the M2a-Taper System.
