Howmedica Argues Against Transfer of ABG II Stem Cases to a Rejuvenate MDL

WASHINGTON, D.C. — Howmedica Osteonics Corp. (NYSE: SYK) has submitted its opposition to motions to coordinate Rejuvenate Total Hip and ABG II Modular stem cases in a single multidistrict proceeding, arguing that not only is the ABG stem a distinct device but there are no such cases pending in federal courts.
Howmedica’s argument came March 18 in response to the first two petitions for coordinated proceedings.
Plaintiffs in Davis v. Howmedica Osteonics Corp. (No. 13-cv-0235, D. Minn.) and associated cases recommended Minnesota as a proper forum for coordinated Rejuvenate and ABG II proceedings, while petitioners in Wilkinson v. Howmedica Osteonics …
