Utah Federal Judge Denies Stryker Summary Judgment in Pain Pump Case

SALT LAKE CITY — Plaintiffs in a failure-to-warn case presented sufficient evidence that Stryker Corp. (NYSE: SYK) knew that the intraarticular use of its pain pumps could cause chondrolysis, a Utah federal judge has ruled, denying the manufacturer’s motion for summary judgment.
On March 18, Judge Dale A. Kimball of the U.S. District Court for the District of Utah also denied Stryker summary judgment on plaintiffs’ claim for punitive damages, ruling that a jury should decide the extent of the manufacturer’s knowledge or constructive knowledge.
