Pa. Appellate Court Vacates $27.6 Million Verdict Against Zimmer, Marketing Firm

HARRISBURG, Pa. — The Pennsylvania Superior Court has vacated a $27.6 million jury award and ordered a new trial on claims that a woman who received Zimmer’s (NYSE: ZMH) Gender Solutions Knee devices in 2006 suffered compensable injuries while making a promotional video for the manufacturer.

The court said March 1, in an unpublished opinion, that the trial court improperly instructed the jury on causation by placing the burden on defendants to disprove the alleged cause of the plaintiff’s injuries.
