First Prempro Class Action Dismissed Without Prejudice in Pa. Federal Court

PHILADELPHIA-A federal judge dismissed one of the first class action lawsuits filed against the manufacturer of Prempro less than a month after the case was filed in state court. Bloch, et al., v. Wyeth, No. 02-CV-4984 (E.D. Pa.).

U.S. District Judge Cynthia M. Rafe's order granted plaintiff June Bloch's motion for voluntary dismissal without prejudice. Bloch's suit claimed that her use of the hormone replacement drug could increase her risk of future injuries such as breast cancer, heart attack, stroke and thromboembolism.

Bloch's complaint also alleged that Wyeth failed to conduct sufficient pre-clinical testing and failed to adequately warn patients …
