NEW YORK - A New York federal judge has granted Satiety Inc. summary judgment on a claim that it negligently manufactured its stomach stapling device in violation of the Investigational Device Exemption, finding the plaintiff failed to sufficiently plead how the device deviated from the IDE.
On March 5, Judge Margo K. Brodie of the U.S. District Court for the Eastern District of New York further found the plaintiff failed to show Satiety destroyed the device “willingly or in bad faith” after her surgery.
