Reclast Complaint Fails to Meet Pleading Standards, Ky. Federal Judge Rules

BOWLING GREEN, Ky. — A Kentucky federal judge has dismissed without prejudice a Reclast injury complaint, finding it did not meet federal pleading standards because it lacked specific factual allegations, including how Novartis Pharmaceutical Corp.’s (NYSE: NVS) warning was inadequate.

However, in the March 4 order, Chief Judge Joseph H. McKinley Jr. of the U.S. District Court for the Western District of Kentucky granted the plaintiff leave to amend her complaint within 30 days.

Angela Aaron alleged she underwent a Reclast infusion in November 2011 to treat her postmenopausal osteoporosis and sustained injury as a result. She sued Novartis, alleging …
