DePuy Pinnacle Plaintiff Opposes Transfer to Coordinated California Proceedings

SAN FRANCISCO — A California hip and knee plaintiff whose lawsuit against DePuy Orthopaedics Inc. (NYSE: JNJ) and others was transferred out of San Francisco Superior Court in 2011 now objects to DePuy’s bid to return the case to the court for pretrial coordination with other Pinnacle defect cases.

Michael J. Assad has asked Superior Court Judge Richard A. Kramer to deny DePuy’s petition to coordinate his action in the DePuy Pinnacle Hip System proceedings, noting his claims against another manufacturer and medical providers and arguing that the DePuy claims do not predominate.
