Wis. Federal Judge Allows Humira Failure-To-Warn Case to Proceed

MADISON, Wis. — A Wisconsin federal judge has denied Abbott Laboratories’ (NYSE: ABT) motion to dismiss a failure-to-warn claim in a Humira injury case, finding the plaintiff's contention that the drug’s label was misleading is plausible.
On Feb. 25, Chief Judge William C. Griesbach of the U.S. District Court for the Eastern District of Wisconsin further found that if it is shown that Abbott was on notice of the risks associated with Humira as early as 2002, a reasonable factfinder could conclude that the drug maker had a duty to warn of these risks.
