CHICAGO — A federal judge has denied summary judgment sought by Zimmer Inc. (NYSE: ZMH) in a Trilogy hip implant case, saying the testimony of the plaintiff’s treating physicians was sufficient to create issues of fact.
Judge William. Hart of the U.S. District Court for the Northern District of Illinois said Feb. 14 that despite the plaintiff’s lack of expert witnesses, the parties’ dispute over what product testing should have been undertaken and what warning should have been given cannot be resolved on summary judgment.
