Miss. Judge Dismisses Failure-To-Warn Claims Against Medicis in Generic Solodyn Case

JACKSON, Miss. — A Mississippi federal judge has dismissed failure-to-warn claims brought against Medicis Pharmaceuticals Corp. (NYSE: MRX) in connection with its acne drug Solodyn because the plaintiff only ingested the drug’s generic equivalent.
On Feb. 7, Judge Daniel P. Jordan of the U.S. District Court for the Southern District of Mississippi predicted the state supreme court would reject the theory that Medici “innovated” Solodyn and is therefore liable for injuries caused by its generic equivalent.
