ST. LOUIS — A Missouri federal judge has remanded a transvaginal mesh case against Boston Scientific Corp. (NYSE: BSX) to state court, finding a nondiverse plaintiff’s claims were not egregiously misjoined because they arise out of the same transaction or occurrence.
Judge Carol E. Jackson of the U.S. District Court for the Eastern District of Missouri held that common questions of law and fact, especially as to causation, are likely to arise in this case.
