Zimmer Durom Cup Parties Report ‘Impasse’ on Swiss Document Discovery

NEWARK, N.J. — Counsel for both sides in the Durom Hip Cup multidistrict proceedings have asked a federal magistrate judge to help resolve an “impasse” over production of documents held by defendant Zimmer’s (NYSE: ZMH) Swiss affiliate that have yet to be produced.
At issue is the parties’ disagreement on wording for a stipulated case management order, including Zimmer’s insistence on language indicating that documents are being produced voluntarily and plaintiffs’ demand for detailed information on any withheld documents, which they say reflects the magistrate judge’s express directive at a December conference.
