SAN DIEGO — A California surgeon is suing hip implant maker Smith & Nephew (NYSE: SNN) to recoup $2.2 million awarded to a patient in binding arbitration, saying the company failed to provide adequate training, procedures or equipment to physicians using its products.
David J. Chao, M.D., an orthopedic surgeon and also the team physician for the San Diego Chargers professional football team, alleges that without those failings by the manufacturer, he and his surgical practice “would have suffered no claim against them and would have suffered no loss.”
