TRENTON, N.J. - A New Jersey federal judge has granted Bristol Myers–Squibb Co. (NYSE: BMY) and Sanofi–Aventis U.S. (NYSE: SNY) summary judgment on claims that the makers of Plavix failed to adequately warn doctors of the risk of severe bleeding.
On Jan. 11, Judge Freda Wolfson of the U.S. District Court for the District of New Jersey found the plaintiff failed establish a genuine issue of fact as to whether the Plavix labeling was inadequate, therefore the learned intermediary doctrine bars the claims.
