LOS ANGELES-Attorneys representing the relatives of a man who killed his wife and then committed suicide after allegedly ingesting Prozac have submitted a stipulated dismissal with prejudice in their appeal for a new trial of claims filed against the manufacturer. Forsyth v. Eli Lilly & Co., No. 00-CV-401 (D. Hawaii).
The June 28 motion was filed after U.S. District Judge Alan C. Kay granted the plaintiff's request for a third continuance in response to the defendant's motion for summary judgment in the case.
