Fungal Meningitis Lawsuits Against Compounding Pharmacy Sent Back to State Court

BOSTON — A Massachusetts federal judge presiding over several lawsuits by plaintiffs who claim they developed fungal meningitis after receiving contaminated steroid injections has sent two of the cases back to the state court.
In orders issued Dec. 11, Judge F. Dennis Saylor IV ruled that because the plaintiffs’ lawsuits do not involve substantial questions of federal law and because defendant New England Compounding Center is a citizen of the state where they were initially filed, his court lacks jurisdiction to adjudicate the cases.
The lawsuits are among more than a dozen that were recently consolidated for pre-trial purposes …
