NEW YORK-A federal judge has granted a motion to dismiss a Canadian man's Rezulin products liability case on the ground of forum non conveniens. U.S. District Judge Lewis Kaplan ruled that the facts of the man's case favor litigation in Canada. In re: Rezulin Products Liability Litigation, MDL No. 1348 (S.D.N.Y.).
Judge Kaplan opined in his Aug. 7 memorandum that although the man claims he was prescribed and ingested Rezulin during a brief tenure in San Diego, the case is better suited for a Canadian Court since the majority of the physicians who administered treatment for his alleged injuries reside …
