Failure to Respond Caused Judge's Decision to Dismiss Oxycontin Case with Prejudice

LEXINGTON, Ky-A Kentucky man's inability to retain new counsel and his failure to respond to a defendant's motion in an Oxycontin products liability suit has prompted a federal judge to dismiss the case with prejudice. Hubbard v. Purdue Pharma, L.P., et al., No. 01-336-DCR (E.D. Ky.).

Plaintiff Harold Hubbard failed to retain new legal representation after Annette Morgan's motion to withdraw as counsel was granted on April 4. Purdure Pharma served Hubbard with a motion to dismiss the case on June 10. Hubbard's lack of response to the motion led to U.S. District Judge Danny C. Reeves' July 29 decision.
