Federal Court Dismisses Pro Se Stryker Complaint for Lack of Diversity Jurisdiction

BOSTON — A federal judge has dismissed a pro se Massachusetts plaintiff’s medical malpractice action against both Stryker Orthopaedics (NYSE: SYK) and a surgeon arising from a hip implant procedure, ruling that the action could not be maintained given Stryker’s uncontradicted assertion that the court lacks subject matter jurisdiction because there is not complete diversity between the parties.
Judge Joseph Tauro of the U.S. District Court for the District of Massachusetts noted in his Oct. 31 ruling that no one has been appointed to represent the estate of the original plaintiff, but limited his ruling to the issue of …
