Judge in Durom Hip Implant MDL Reduces Common Fund Contributions After Recent Settlements

NEWARK, N.J. — U.S. District Judge Madeline Cox Arleo has reduced settling plaintiffs’ contributions to a common benefit fund in several recent cases in the Zimmer (NYSE: ZMH) Durom Cup hip implant proceedings.

Judge Arleo issued orders on Oct. 16 and Sept. 11 reducing the percentage of contribution from 4 to 1 percent in five cases that were settled through the efforts of mediators.

In each order, Judge Arleo noted that the court provided for such reductions in creating the plaintiffs’ Common Benefit Fund in Case Management Order No. 3 on Jan. 21, 2011, “based upon the factors set forth …
