NexGen Plaintiff Says Dismissal of Class Claims Would be Premature

CHICAGO — Zimmer (NYSE: ZMH) NexGen knee implant plaintiff Loretta Albert says in response to Zimmer’s motion that dismissal of her class claims would be premature, given that she has not moved for certification, and that her remaining claims are sufficiently detailed to meet the Iqbal/Twombly pleading standard.

Albert filed her response Oct. 22 in the NexGen multidistrict proceedings pending in the U.S. District Court for the Northern District of Illinois, adding that she should be allowed to amend her complaint if the court should find any of her allegations insufficient.
