HarrisMartin: Plaintiffs Seek Centralization of Lawsuits Involving Fungal Meningitis Outbreak Linked to Contaminated Steroid Injections

WASHINGTON, D.C. — The plaintiffs in a contaminated steroid case against New England Compounding Pharmacy have moved the Judicial Panel on Multidistrict Litigation to coordinate and transfer all federal compounding pharmacy cases to the U.S. District of Minnesota for consolidated pretrial proceedings, HarrisMartin Publishing is reporting in its Drugs & Medical Devices Litigation Report.

In an Oct. 16 filing, Brenda and Robert Bansale assert that pretrial proceedings, including class certification, motion practice, discovery and damage issues in all of the compounding pharmacy cases will involve the same evidence and arguments and therefore consolidation is appropriate under 28 U.S.C. Section 1407.
