MIAMI – A Florida federal judge has refused to dismiss negligence and strict liability claims brought by a man who alleges that Alcon Laboratories Inc’s (NYSE:NVS) off-label marketing of its Nevanac eye drops caused him to sustain serious eye injuries.
On Oct. 9, Judge Robin S. Rosenbaum of the U.S. District Court for the Southern District of Florida ruled that the plaintiff adequately alleged that the drug maker’s marketing practices were a direct and proximate cause of his corneal scarring.
