Colorado Judge Rejects Wright’s ‘Unavoidably Unsafe’ Defense in Profemur Hip Implant Case

DENVER — A federal judge has dimsissed manufacturing defect and some warning claims brought against Wright Medical Technology (NYSE: WMGI) over an allegedly defective PROFEMUR™ Total Hip System but will allow plaintiffs to pursue a claim that the company could have used a safer design.
Judge David M. Ebel of the U.S. District Court for the District of Colorado said Sept. 30 that plaintiffs presented sufficient evidence of an effective alternative design to defeat Wright’s motion for summary judgment on a design defect cause of action and on post-operative failure to warn.
