NEW ALBANY, Ind. — A federal judge has refused to dismiss tort claims against Coloplast Corp. filed by an Indiana man who claims he was implanted with a defective urethral sling device one year after the FDA warned that a similar mesh product was causing complications in women.

Judge Richard L Young of the U.S. District Court for the Southern District of Indiana ruled Sept. 29 that Coloplast was aware of the FDA warning in 2008, suggesting that there may have been a defect in the product’s design.
