S.C. Judge Cites 181 Pending Remand Motions in MDL in Staying DePuy ASR Hip Case

COLUMBIA, S.C. — A South Carolina judge declined to address the viability of a plaintiff’s claims against an in-state defendant or the likelihood of remand to state court and stayed a DePuy (NYSE: JNJ) ASR hip implant case pending its transfer to the federal MDL.
Judge Joseph F. Anderson Jr. noted in his Oct. 1 order that, at last count, U.S. District Judge David A. Katz is already considering motions to remand in 181 other cases removed from state courts before being transferred to the MDL pending in the U.S. District Court for the Northern District of Ohio.
