PHOENIX — A federal judge has granted Wright Medical Technology’s (NYSE: WMGI) motion to dismiss failure to warn and breach of warranty counts from a hip implant lawsuit, but rejeced efforts to dismiss design defect and punitive damage claims.
Judge David G. Campbell of the U.S. District Court for Arizona granted Wright’s motion in part Oct. 3, but also granted plaintiff Virginia M. Welch’s motion for leave to file an amended complaint, giving her until Oct. 19 to do so.
