COLUMBUS, Ohio — An Ohio federal judge has granted the makers of brand name Reglan summary judgment on claims that they failed to adequately warn of the drug’s risks, ruling that the claims are barred by the Ohio Product Liability Act because the plaintiff only ingested Reglan’s generic equivalent.
On Sept. 27, Judge Michael H. Watson of the U.S. District Court for the Southern District of Ohio rejected the plaintiff’s assertion that the brand name manufacturers are liable for the dissemination of false information regardless of whether they made the actual drug she ingested.
