3 Maryland Plaintiffs Oppose DePuy’s Motion to Sever Their ASR Hip Claims for Trial

UPPER MARLBORO, Md. — Three Maryland plaintiffs who filed a joint complaint alleging injuries from allegedly defective DePuy (NYSE: JNJ) ASR XL hip replacement systems say in a recent filing that DePuy has exaggerated “minor factual differences” in moving to sever their claims for separate trials.

Moira Jackson, Robert O’Bryhim and Kathyrn Rassier filed their opposition to DePuy’s sealed motion to sever in the Circuit Court for Prince George’s County (Md.) Sept. 14.

Defendants have asked Prince George’s County Circuit Judge Crystal Dixon Mittelstaedt for a hearing on the motion. The case is currently scheduled for trial in January.
