Triathlon Plaintiff Moves to Stay Stryker’s Dispositive Motions Pending Remand

MONTGOMERY, Ala. — An Alabama plaintiff has asked a federal judge to stay any action on Stryker’s (NYSE: SYK) motion for partial summary judgment in her Triathlon knee implant lawsuit, saying the court should resolve jurisdictional issues first.

In-state defendant Brennan Blackmon, meanwhile, has moved for dismissal, arguing that the claims against him as a marketer and distributor of the Triathlon products are untenable were brought only to defeat the court’s diversity jurisdiction.

Plaintiff Elizabeth Culpepper has asked the U.S. District Court for the Middle District of Alabama to stay that motion, as well.
