Nevada Federal Judge Grants Glaxo Summary Judgment in Generic Paxil Case

RENO, Nev. — A Nevada federal judge has granted GlaxoSmithKline LLC (NYSE:GSK) summary judgment on claims that its misrepresentations caused a woman who was taking the generic version of its antidepressant Paxil to kill her husband, ruling that the drug maker cannot be held liable for injuries caused by a product that it did not manufacture.

On Sept. 6, Judge Robert C. Jones of the U.S. District Court for the District of Nevada explained that under Nevada law, plaintiffs asserting strict liability claims must establish that the defendant manufactured or sold the specific product that allegedly injured the plaintiff.
