Stryker Says Plaintiff’s Triathlon Knee Implant Tort Claims Are Time-Barred

MONTGOMERY, Ala. — Stryker Corp. (NYSE: SYK) has moved for partial summary judgment in a Triathlon Knee implant case, asserting that the suit was filed outside Alabama’s statute of limitations for torts.

Stryker filed its motion Sept. 4, the same day the defendant removed the suit from the Bullock County (Ala.) Circuit Court to the U.S. District Court for the Middle District of Alabama, asserting complete diversity.

Plaintiff Elizabeth Culpepper alleges injuries from a “Stryker Triathlon Posteriorly Stabilized Total Knee Replacement System” implanted in November 2009. She maintains the device was inadequately designed, tested and manufactured by Stryker and affiliates.
