GALVESTON, Texas — A Texas man who suffers from chromium and cobalt poisoning allegedly caused by failed hip implants manufactured by DePuy and Biomet may proceed with his claims in state court if a federal court adopts a magistrate’s recent ruling to remand the case.

Plaintiff Rick Gardner is urging the Texas court to accept the conclusions in Magistrate Judge John R. Froeschner’s report and recommendation that the entire case against the manufacturers and a physician Gardner sued for malpractice be kept intact and returned to Brazoria County District Court where it was originally filed.
