Plaintiffs Ask JPML to Transfer, Consolidate Nexium Cases

WASHINGTON, D.C. — Plaintiffs in Nexium injury actions pending in 16 federal district courts have asked the Judicial Panel on Multidistrict Litigation to transfer their cases to the Central District of California for coordinated and consolidated pretrial proceedings.
In an Aug. 27 petition, plaintiffs assert that all of the complaints in the Nexium cases assert similar causes of action, including strict liability, failure to warn, negligence, deceit by concealment and negligent misrepresentation. All of the complaints contain similar factual allegations, therefore any discovery will arise from common questions of fact, plaintiffs argue.
