SAN FRANCISCO — A California federal judge has remanded eight Plavix injury cases, ruling that the state court must determine whether the design defect claims against the California distributor defendant and the drug maker are barred under 9th Circuit law.
On Aug. 10, Judge Edward M. Chen of the U.S. District Court for the Northern District of California further ruled that there is no federal jurisdiction pursuant to the Class Action Fairness Act because the cases are not a “mass action” as defined by the act.
