Nevada Plaintiffs Ask Judge to Reconsider Stays Imposed in 12 DePuy ASR Cases

LAS VEGAS — Plaintiffs in most of the 12 DePuy ASR hip implant cases stayed by a Nevada federal judge Aug. 14 have moved for reconsideration, arguing that plaintiffs would be prejudiced by the delays and that defendant DePuy Orthopaedics provided the court with a “misleading description” of the status of proceedings in the MDL in Ohio.

Contrary to DePuy’s argument, the plaintiffs say in individual motions to reconsider, they will be prejudiced by delays in litigating their claims if the cases are transferred, and the implied preemption argument raised by defendants and cited by the judge is not …
