TRENTON, N.J. — A New Jersey appellate court has reversed plaintiffs’ verdicts in three Accutane injury cases, ruling that the plaintiffs failed to establish proximate causation under Florida law. Sager, et al. v. Hoffman-LaRoche Inc., et al., Nos. A-3427-09T4, A-3428-09T4 and A-3702-09T4 (N.J. App. Div.).
On Aug. 7, the New Jersey Superior Court, Appellate Division, found that because prescribing doctors testified that they still would have prescribed the acne drug had a stronger warning regarding the risk of inflammatory bowel disease been issued, proximate cause was not established.
