PITTSBURGH — A Pennsylvania man alleges in a recently filed complaint that the polyethylene component in a Triathlon Total Knee System implanted in 2007 failed because of a defective design and negligence in its manufacture. Marx v. Stryker Corp., et al., No. 2:12-cv-01093 (W.D. Pa.).
Albert J. Marx and co-plaintiff Kathleen Miskovich filed the product liability suit against Stryker Corp. and affiliates in the Allegheny County (Pa.) Court of Common Pleas June 29. Stryker removed the action to the U.S. District Court for the Western District of Pennsylvania on Aug. 2 on the basis of complete diversity.
