MIAMI - A Florida federal judge has dismissed a Trasylol injury suit, ruling that the claims are time-barred under Texas law because the plaintiff should have known of the link between her alleged injuries and the drug by January 2006, when a published study outlining such risks was widely reported by the media. Coleman v. Bayer Corp., No. 9:09-82050 (S.D. Fla.).
On May 9, Judge Donald M. Middlebrooks of the U.S. District Court for the Southern District of Miami dismissed the claims of strict liability, negligence, unjust enrichment and breach of implied warranties.
