Biomet Cites Diversity in Removing Knee Implant Case to Federal Court in Florida

WEST PALM BEACH, Fla. - Biomet Inc. has removed a Florida plaintiff's knee implant lawsuit to the U.S. District Court for the Southern District of Florida, asserting complete diversity between the parties. Johncox v. Biomet Inc., No. 9:12-cv-80419-KLR (S.D. Fla.).

Indiana-based Biomet filed its Notice of Removal April 19 in the suit filed by Gregory Johncox, a Florida resident.

Besides citing diversity, Biomet also maintains that the amount in controversy meets the court's $75,000 threshold based on what it said was a pre-suit settlement demand for $175,000.
