SACRAMENTO, Calif. - A plaintiff seeking damages for an alleged manufacturing defect in a femur stem implant has sufficiently pled negligence and strict liability claims to withstand a motion to dismiss, a federal judge has concluded. Currier v. Stryker Corp., et al., No. 2:11-cv-1203 (E.D. Calif.).
Judge John A. Mendez of the U.S. District Court for the Eastern District of California ruled March 27 that, taking Travis J. Currier's allegations as true at this stage of the litigation, he has sufficiently stated a claim for both causes of action.
