EAST ST. LOUIS, Ill. - An Illinois federal judge has granted Bayer summary judgment on Trasylol injury claims, ruling that the plaintiff should have known in 2004 whether a cause of action existed, therefore his claims are time-barred. Gilmore v. Bayer Corp., No. 09-986 (S.D. Ill.).
On March 29, Judge G. Patrick Murphy of the U.S. District Court for the Southern District of Illinois noted that the discovery rule "places the burden on plaintiffs to inquire as to the existence of a cause of action."
