NEW YORK - A New York federal judge has dismissed a Lybrel injury suit, ruling that the amended complaint does not set forth facts supporting the plaintiff's claim that the drug was defective and not accompanied by adequate warnings. Reed v. Pfizer Inc., et al., No. 05356 (E.D. N.Y.).
Judge Eric N. Vitaliano of the U.S. District Court for the Eastern District of New York granted the plaintiff leave to amend her complaint a second time, noting that she "may yet be able to plausibly re-plead at least some of her claims."
